Holidays Act remediation
We are working to pay current and former school employees who did not receive all money due for leave and holidaysThe Ministry has identified non-compliance with the Holidays Act 2003 in the schools payroll.
We are calculating money owed to current and former school employees to correct their pay from 1 March 2010 onwards.
Payments
Current employees
Between June 2023 and March 2024, we made 95,300 initial estimate payments to current employees, totalling $46.1 million.
The timing of further payments is still to be determined.
Former employees
The timing of payments to former employees is still to be determined. We won’t know who is due a payment until calculations are complete.
Work underway
The schools payroll is complex and it's one of the largest in Australasia. This means it's taking some time to ensure everyone receives what they are owed.
We are undertaking Holidays Act remediation on behalf of 2,500 schools and for around 235,000 current and former employees across 550,000 roles.
We have worked with sector representatives on remediation principles and payroll data rules. Work to build and test a remediation calculator, and prepare the large historic payroll dataset for calculations is ongoing.
Reaching compliance
Compliance with the Holidays Act will require a range of solutions, including system, process and practice changes.
After historic errors are addressed, the Ministry will pay remediation on an ongoing basis until the schools payroll is compliant with legislation.
